Rick asks: LEED EQ Credit 5, Indoor Chemical and Pollutant Source Control – According to manufacturer a filter is not required at the fan inlet on fan powered VAV boxes after construction. Does LEED require a filter for the recirculated air on fan powered VAV boxes? If a filter is required does it have to meet MERV-13? Rick, this is a great question and one that I have dealt with multiple times on LEED projects. The short answer to your question is that all equipment used to re-circulate air in regularly occupied areas of a building is required to have a MERV 13 or higher filter. The fact that the manufacturer does not require filtration simply means that the performance of their equipment will not be adversely affected by the dust and particulate matter that a filter would catch. LEED is very adamant about pollutant source control and the filtration being able to process both outdoor air and return air. You are probably discovering that this becomes a problem when using fan powered VAV boxes, fan coil units, or small packaged heat pumps as these units typically have fans with very low external static pressure capacity.

Unfortunately, outside of using a supplemental fan to overcome the extra static pressure of a MERV 13 filter there is little you can do to earn this credit if using the aforementioned systems. One thing to consider is LEED’s definition of a regularly occupied space.
